Guiding H-1B Visa Holders

As part of the Tech Talent Strategy, the Immigration, Refugees and Citizenship Canada (IRCC) will introduce a new 3-year Open Work Permit for H-1B visa holders in the US. Starting July 16th, 2023, H-1B holders and their accompanying family members can apply to come to Canada. Approved applicants will receive an Open Work Permit, allowing them to work for any employer in Canada, while their spouses and dependents can apply for a temporary resident visa.


Innovation Stream and Digital Nomads

To further support the tech industry, IRCC will develop a new Innovation Stream under the International Mobility Program. This stream will create an exemption from the Labour Market Impact Assessment (LMIA) process, making it easier for employers and talented workers to contribute to Canada's innovation priorities.

Additionally, IRCC aims to attract digital nomads, individuals who can perform their job remotely from anywhere in the world. Collaborating with public and private partners, IRCC will explore policies to make Canada an attractive destination for digital nomads, who may later decide to seek opportunities with Canadian employers.


Express Entry Draws for STEM Professionals

Recognizing the need to fill labour market shortages in STEM professions, IRCC will launch category-based selection draws for Express Entry candidates. Preference will be given to candidates with strong French language proficiency or work experience in STEM fields. This initiative aims to bridge the skills gap and ensure Canada's tech industry thrives.


Enhancements to Existing Tech Programs

Yanique Russell Law also supports foreign entrepreneurs looking to make Canada their home, through the Start-Up Visa (SUV) program, which provides a path to permanent residence for foreign entrepreneurs with support from designated Canadian organizations. Recent improvements, including longer work permits and increased application spots, offer greater opportunities for talented individuals to contribute to Canada's tech sector.
